1. This matter is taken up through hybrid mode.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 1st April, 2022 in connection with Ambabhana P.S.

Case No.39/2022 corresponding to C.T. Case No.282/2022 pending in the court of learned S.D.J.M., Bargarh for the alleged commission of the offence under Section 395 of I.P.C.

4. This is a peculiar case inasmuch as the F.I.R. was lodged by the Petitioner himself to the effect that while he and the driver of a truck loaded with Bidis were proceeding to Bargarh, three persons assaulted them and snatched away cash of Rs.3 lakhs.

// 2 // In course of investigation some of the stolen cash was recovered from the co-accused persons and, therefore, the Petitioner was also held to be involved in the alleged occurrence.

5. Taking into consideration the fact that out of Rs.3 lakhs, a sum of Rs.1,49, 500/- has already been recovered and practically nothing further remains to be done in so far as the investigation is concerned, I am inclined to allow the prayer for bail.

6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that including the conditions that he shall furnish cash security of Rs.50,000/-(Rupees Fifty Thousand), and he shall appear before the trial court on each date of posting of the case, failing which it shall be open to the said court to pass necessary orders to take him to custody again.

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
