This matter is taken up through hybrid arrangement (virtual/physical) mode.

This application has been filed for modification of the condition imposed on the Petitioner by this Court while granting anticipatory bail vide order dated 10.11.2022 passed in ABLAPL No.6737 of 2022.

Learned Counsel for the Petitioner submits that the Petitioner in obedience to the direction of this Court has been appearing before the IIC, Phulbani P.S. after being released on bail on Monday once in a month. He further submits that the Petitioner being a wage earner having appeared before the IIC, Phulbani P.S. pursuant to the above direction till now; that condition as to his further appearance be waived as that would cause extreme hardship to him in all fronts.

Learned Counsel for the State opposes the move.

Considering the submissions made and on going through the earlier order dated 10.11.2022 passed in ABLAPL No.6737 of 2022, when it is stated that the Petitioner has been abiding by the condition till now and appearing before the IIC, Phulbani P.S., at this stage, this Court is inclined to waive the imposed condition as to his appearance before the IIC, Phulbani P.S. on Monday once in a moth in between 10.00 am to 2.00 pm for a period of one year by substituting it the condition that he will appear before the IIC, Phulbani P.S. as and when so required by the IIC and will give his present contact address and cell phone number by way of an affidavit before the concerned Court and to concerned IIC and in case of change would so intimate in that manner. 6.

The I.A. is accordingly disposed of.

Issue urgent certified copy as per rules.
