Heard learned counsel for both the parties.

This writ petition is challenged the order of eviction dated 9.5.2022 under Annexure-4 directing the Petitioner to evict the land in question within a period of three days.

In course of hearing, learned counsel for the Petitioner wants to withdraw the writ petition with liberty to file appeal involving the encroachment case. In the event the Petitioner is still in possession of the disputed property, liberty is granted to file appeal along with applications for condonation of delay and interim protection. If such applications are filed, the delay shall be condoned and the appeal shall be heard on its own merit and the interim application shall also be taken up and decided. For a period of six weeks, there shall be no coercive action against the Petitioner pursuant to Annexure-4. 4.
Writ Petition stands disposed of with the aforesaid liberty. 5.
Issue urgent certified copy as per rules.
