1. The writ appeal is restored in view of the order passed today in Order No.

CMAPL No.74 of 2015.

2. This writ appeal is directed against an order in a writ petition in which an order dated 31st October, 2008 passed by the Civil Judge (Jr. Division), Panposh, Rourkela in C.M.A. No.28 of 2006, arising out of Execution Case No.3 of 2006, rejecting the petition under Section 47 of C.P.C, was assailed.

3. Since the impugned order was in exercise of the jurisdiction of the Court under Article 227 of the Constitution, this writ appeal is not maintainable as in dismissed as such.
