Undisputedly the Petitioner has pending appeal alleging illegal recording of the disputed land in favour of the private Opposite Party Nos.5 & 6.

Learned counsel for the Petitioner draws the attention of this Court to the challenge made to the recording in favour of the Opposite Party Nos.5 & 6 and submits that the same remains contrary to the order of the competent authority vide Annexure-3. 3.

Considering the submission made by the learned counsel for Petitioner and for the pendency of the appeal at the instance of the Petitioner, this Court is unable to proceed with the matter at this stage, but however in disposal of the writ petition this Court directs, if the appeal at the instance of the Petitioner is still pending, the same shall be disposed of in accordance with law and also taking into consideration the development through the order at Annexure-3. This
