This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is an accused in connection with T.R. Case No. 556 of 2021 arising out of Laxmisagar P.S. Case No. 406 of 2021, pending on the file of the learned Sessions Judge, Khurda at Bhubaneswar, for the alleged commission of offence under Sections 20(b)(ii)(C) of the NDPS Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge, Khurda at Bhubaneswar, by Order dated 10.02.2022, the present BLAPL has been filed.

On perusal of the record it is seen that to the tune of 102 Kgs. 700 grams of Ganja was carried by a scooter and the Petitioner is one of the pillion riders of the said vehicle.

Keeping in view the manner of seizure and quantity of contraband seized, this Court is not inclined to entertain this bail application at this stage, the BLAPL stands rejected. The petitioner is at liberty to move at a later stage after examination of the material witnesses.
