This matter is taken up through Hybrid mode.

This writ petition has been field for a direction to the State Information Commission, Bhubaneswar (for short, 'the Commission') to dispose of Second Appeal filed by the Petitioner.

Mr. Rath, learned counsel for the Petitioner submits that although Second Appeal has been filed since 3rd February, 2021 no information has been supplied nor the registration of the appeal and the stage at which the said appeal is pending before the Commission, has been provided to the Petitioner. 4.

Taking into consideration the submission of learned counsel for the Petitioner, this Court vide order dated 21st June, 2022 directed Mr. Dash, learned counsel for the Commission to take instruction in the matter.

Mr. Dash, learned counsel for the Commission, on instruction, submits that the Second Appeal filed by the Petitioner has been registered as SA No.356 of 2021 and is pending for adjudication.

In view of the above, this Court disposes of the writ petition with a direction that in the event, Petitioner files an application for early disposal of SA No.356 of 2021 before the Commission within a period of two weeks hence, the Commission shall do well to consider the said application for early disposal of the Second Appeal within a period of one month therefrom giving opportunity of hearing to the parties concerned and proceed ahead for final disposal of the Second Appeal, fixing the date of hearing, if the matter is otherwise ready for hearing and there is no legal impediment for its disposal.

Issue urgent certified copy of the order on proper application.
