1.The Respondent was 50 years at the time of filing of the writ petition O.J.C. No.3458 of 2000 in which the impugned judgment was passed by the learned Single Judge on 8th October, 2015, this Court asking the present Appellant to comply with the order of UmakantaPradhan v. Orissa Forest Development Corporation(dated 17th March, 2015 in O.J.C. No.3459 of 2000).

2. It was perhaps not notice that the writ petitioner had already crossed the age of superannuation and therefore there is no question of his reinstatement in service. Not surprisingly therefore the writ petitioner does not appear to have filed any contempt petition asking implementation of the order of the learned Single Judge in the last seven Years during which the writ appeal has been pending.

3. With the writ petitioner being now 70 years of age, the question of his reinstatement in service that cannot arise at all. Consequently, the impugned order of the learned Single Judge cannot be implemented and therefore there is no need for the Court to interfere with at this stage. Accordingly, the writ appeal is dismissed.
