This matter is taken up through virtual/physical mode. 2.

The present intra-court appeal is directed against the order dated 16th May, 2022 passed by learned Single Judge in W.P.(C) No.25241 of 2013, whereby the petition filed by the Defendant in a civil suit for permission to file the written statement to the plaint has been allowed with further direction to the trial court to conclude the suit vide C.S. No.235 of 2001 within a period of one year.

At the time of hearing, realizing that the present appeal would not be maintainable against the order 16th May, 2022 passed by learned Single Judge in W.P.(C) No.25241 of 2013, he prays for permission to withdraw the present writ petition. A memo to that effect has been filed in Court today, which is taken on record.

In view of the above, the writ appeal is dismissed as withdrawn.
