This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

The petitioner seeking pre-arrest bail in connection G.R. Case No.733 of 2022, arising out of Khurda Sadar P.S. Case No.73 of 2022 pending in the court of learned S.D.J.M., Khurda for commission of offence punishable under Sections 379/341/511/353/332/294/336/ 307/506/34, I.P.C. read with Section 68 of OMMC Rules, 2004 5.
Considering the nature of allegations and taking into account that even though, F.I.R. was lodged by the I.I.C. Khurda Sadar Police Station and he has not been named in the F.I.R. It is submitted that on account of political consideration, the petitioner has been arrayed as an accused. It is further submitted by learned counsel for the petitioner
// 2 // that on similar footing with the present petitioner, other co-accused persons have already been released on bail by this Court by order dated 12.07.2022 in ABLAPL No.6693 of 2022, ABLAPL No.6711 of 2022 and ABLAPL No.6708 of 2022.

Taking note of the recitals in the F.I.R., this Court directs that on surrendering within three weeks hence, and moving for bail, the petitioner shall be released on bail by the learned court in seisin over the matter on such terms and conditions as would be deemed just and proper.

Accordingly, the ABLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
