Heard learned counsel for the parties.

The Petitioner is an accused in connection with G.R. Case No. 40 of 2021 arising out of Kundheigola P.S. Case No. 193 of 2021 pending on the file of learned Addl. Sessions Judgecum-Special Judge, Deogarh, registered for the alleged commission of offence under Sections 323/341/376(2)(n)/506/34 of the I.P.C. read with Section 6 of POCSO Act. 4.

Being aggrieved by the rejection of their application for bail U/s 439 Cr.P.C. by the I/C Addl. Sessions Judge-cum-Special Judge, Deogarh by order dated 01.06.2022, the present BLAPL has been filed 5.

Considering the 164 Cr.P.C. statement of the victim, which describes the alleged incident took place six years back and keeping in view that the Charge Sheet has already been filed, this

Court directs the petitioner to be released on bail on such terms to be fixed by the court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
