This matter is taken up through hybrid mode.

This RPFAM has been filed assailing the judgment and order dated 6th October, 2010 passed by learned Judge, Family Court, Rourkela in Criminal Proceeding No.8 of 2010. 3.

On perusal of the order sheet, it appears that this Court vide order dated 25th August, 2011 while issuing notice in the matter of limitation, granted an interim order. It appears that delay in filing the RPFAM has not been condoned. The notice on the Opposite Parties is sufficient. Today, none appears on behalf of Opposite Parties to pursue the matter.

Accordingly, the RPFAM stands dismissed for nonprosecution. 5.

The interim order dated 25th August, 2011 passed in Misc. Case No. 76 of 2011 stands vacated.
