Heard Mr. D.R. Mishra, learned counsel for the petitioners and Mr. K.K. Gaya, learned Additional Standing Counsel for the State.

Perused the communication of the learned Additional District & Sessions Judge-cum- Special Judge, Gunupur dtd. 24.02.2022, wherein inter alia it is stated that because of the cessation of the work by the learned members of the Bar, the trial is held up. It has also been stated that one of the co-accused- Jitu Kadraka has not surrendered after being released on interim bail.

On a conspectus of materials on record, this Court is not inclined to exercise its discretion under Section-439 Cr.P.C,. Accordingly, the BLAPL thus stands dismissed. 5.
