This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Special G.R. Case No.17 of 2021, on the files of learned Additional District Judge-cum-Special Court under POCSO Act, Cuttack, arising out of Markat Nagar P.S. Case No.15 of 2021, under Sections 376/323/506/34 of IPC along with Section 4 of POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the ADJ-cum-Special Court under POCSO Act, Cuttack, by order dated 29.04.2021 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the State on instruction submits that notice has already been served on Opposite Party No.2. But there is no appearance on behalf of the said Opposite Party when the matter is called.

Perused the 164 State and considering the tenor of the same, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin of the matter. The learned Court in seisin over the matter to fix the terms. 7.

Accordingly, the BLAPL stands disposed of.
