This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The Petitioner is an accused in connection with Special Case No. 120 of 2022 corresponding to Soro P.S. Case No. 251of 2022 pending on the file of learned Addl. Sessions Judge-cumSpecial Judge, Balasore, registered for the alleged commission of offence under Sections 363/366/376(2)(n) of the I.P.C. and Sec.6 of the POCSO Act.

Being aggrieved by the rejection of their application for bail U/s 439 Cr.P.C. by the Addl. District Judge-cum-Special Judge, Balasore(I/C) by order dated 04.06.2022, the present BLAPL has been filed.

The petitioner is stated to be in custody since 28.05.2022. 6.

Perused the 164 Cr.P.C. statement of the victim produced by the learned counsel for the State.

Taking into account the tenor of the same and also noting that the Charge Sheet has already been filed, as stated by the learned counsel for the Petitioner, this Court directs the petitioner to be released on bail. The terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
