This matter is taken up through Hybrid Mode.

The petitioner is accused in connection with G.R. Case No. 335 of 2021 corresponding to Khaprakhol P.S. Case No. 68 of 2021, pending on the file of the learned S.D.J.M., Patnagarh for the alleged commission of offence under Sections-274/275/120(B) of the IPC and is in custody since 07.05.2021.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned Additional Sessions Judge, Patnagarh in BLAPL No. 61 of 2021 by Order dtd. 17.05.2021, the present BLAPL has been filed.

Heard Mr. A.P. Bose, learned counsel for the petitioner and Mr. K.K. Gaya, learned Additional Standing Counsel for the State. 5.

Learned counsel for the petitioner referring the Order passed by this Court dtd. 31.03.2022 in BLAPL No. 4178 of 2021

and Order dtd. 22.11.2021 in BLAPL No. 8453 of 2021, seeks to be enlarged on bail inter alia on the ground of parity. 6.

Taking into account that the Charge-sheet has already been filed and the period of custody and release of the co-accused as stated above, this Court directs that, the petitioner shall be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

The Bail Application thus stands disposed of. 8.
