This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

The petitioner seeking pre-arrest bail in connection G.R. Case No.58 of 2016, arising out of Tangi P.S. Case No.36 of 2016 pending in the court of learned N.G.N.-cum-J.M.F.C., Tangi for commission of offence punishable under Sections 341/294/323/307/379/506/34 of I.P.C.

It is submitted by learned counsel for the petitioner that on similar footing with the present petitioner, other co-accused persons have already been released on bail. Further, it is submitted by learned counsel for the petitioner that the injuries sustained by the injured are simple in nature.

Considering the nature of allegation, gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioner. However, it is directed that in the event the petitioner surrender before the learned court in seision over the matter in the aforesaid case within a period of three weeks from today, he shall be released on bail by furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with one solvent surety for the like amount to the satisfaction of the learned court in seisin over the matter. 7.

Accordingly, the ABLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
