This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Additional Government Advocate.

The Petitioner has filed this writ petition with the following prayer :

"The Petitioner therefore prays that Your Lordship may graciously be pleased to direct the Opp.Partis to modify the Grade Pay to Rs.5400/- instead of Rs.4800/- at the stage of 3rd Financial Upgradation w.e.f. 01.05.2015 in favour of the Petitioner, as has been sanctioned in favour of the similar employees under Annexure-2 with all consequential benefits within a stipulated time, And pass such order/direction as this Hon'ble Court may deem fit and proper"

In course of hearing, learned counsel for the Petitioner submits that the Petitioner may be granted liberty to file a fresh representation ventilating his grievance before the Collector & District Magistrate, Jagatsinghpur-Opposite Party No.3. It is also submitted by the

// 2 // learned counsel for the Petitioner that the Opposite Party No.3 may be directed to consider the representation of the Petitioner in accordance with law within a stipulated period of time. 5.

Learned counsel for the State on the other hand submits that he has no objection if liberty is granted to the Petitioner to file a file representation before the Opposite Party No.3 and the same is considered and disposed of in accordance with law. 6.

In view of the aforesaid limited nature of grievance of the petitioner, this Court disposes of the writ petition granting liberty to the Petitioner to file a fresh representation before the Opposite Party No.3 ventilating his grievance along with all supporting documents within a period of two weeks. If such a representation is filed within the time stipulated, the same shall be considered and disposed of by the said Opposite Party No.3 in accordance with law within a period of two months. The Opposite Party No.3 shall do well to dispose of the representation of the Petitioner strictly in accordance with law by passing a reasoned and speaking order. The decision so taken on the representation of the petitioner shall be communicated to the Petitioner within two weeks thereafter.

With the aforesaid observation the writ application stands disposed of.

Urgent certified copy of this order be granted on proper application.
