This matter is taken up through hybrid mode.

The petitioner has filed this writ petition seeking direction for postponement or not taking any decision for construction of Balinalla-II & III check dams over Balinalla near Sanahantuada village of Galua GP of Khurda district and to direct opposite party no. 3 to refund the APS amount deposited by him.

Since the tender is of the year 2017-18 and the petitioner claims for refund of APS amount, it is open to the petitioner to pursue his remedy before the appropriate forum in terms of the DTCN/agreement executed between the parties, which is applicable to it.

With the aforesaid liberty, the writ petition stands disposed of.
