This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

The petitioner seeking pre-arrest bail in connection G.R. Case No.08 of 2022(V), arising out of Jeypore Vigilance P.S. Case No.10 of 2022 pending in the court of learned Special Judge, Jeypore for commission of offence punishable under Sections 13(2) read with Section 13(1)(b) of P.C. (Amendment) Act, 2018. 5.

Considering the nature of allegations and taking into account that even though, F.I.R. was lodged by the I.I.C. Jeypore Vigilance Police Station. It is submitted by learned counsel for the petitioner that the petitioner is a lady and the wife of the Government employee, who has been trapped by the Vigilance Department in D.A. case and that the petitioner has been falsely implicated in this case by the Vigilance

// 2 // Department as because a land was sold in her name by her husband and that she is no way connected with the present case. The bail application of the petitioner may be considered.

Taking into consideration the nature of allegation, gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioner. However, it is directed that in the event the petitioner surrender before the learned court in seisin over the matter, she shall be released on bail on such terms and conditions as would be deemed just and proper subject to condition that she shall cooperate with the Investigating Officer as and when required for the purpose of investigation.

Accordingly, the ABLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
