This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 12th May, 2011 passed by the learned J.M.F.C., Kashipur in G.R. Case No.74 of 2011, taking cognizance of offences under Sections 47(a) & 55 of the Bihar & Orissa Excise Act.

No one appears on behalf of the Petitioner when the matter is called.

The case is of the year 2011.

As such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution. 7.

Interim order dated 18th July, 2011 passed by this Court in Misc. Case No.1366 of 2011 stands vacated. 8.
