1. This matter is taken up through hybrid mode. Order No.
1.
2. Heard learned counsel for the Petitioner and learned Additional Standing Counsel for the State.
3. The case of the Petitioner is though Ward No.13 of Arjunpur Primary Agriculture Cooperative Society, Limited, Balangir was meant for Women (Unreserved) Category as per the Election Notification issued on 13.05.2022; yet in the final list of candidates, one Sumitra Biswal finds place who belongs to the OBC Category. Therefore, the Petitioner filed an objection before the Election Officer which was rejected but no written order was passed.
4. Considering the facts and circumstances of the case and keeping in view the fact that the election is scheduled to be held on 19th of this month, the writ petition is disposed of granting liberty to the Petitioner to submit a fresh representation before the Election Officer taking all such
grounds as are available in law.
5. The Petitioner shall be at liberty to move such a representation before the Election Officer on or before 17th June, 2022 which shall be disposed of on the same day by the Election Officer. In the event such representation is filed, the same shall be considered and disposed of in accordance with law.
6. Urgent certified copy of this order be issued as per rules in course of the day.
