Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 19.04.2022 in connection with Kesinga P.S. Case No.170 of 2022 corresponding to C.T. Case No.25 of 2022 pending in the Court of learned Addl. Sessions Judge-cum-Special Judge, Bhawanipatna for the alleged commission of offence under Sections 20(b)(ii)(C) of NDPS Act. 4.

It is alleged that the petitioner was carrying contraband ganja in his motorcycle when he was apprehended by police. One of the co-accused persons, namely, Rohan Tandi has been granted bail by this Court in BLAPL No. 5546 of 2022. Nothing was seized from the possession of the petitioner. He was present near the spot as he had met with an accident fracturing his leg thereby.

Taking into account all the above facts, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on

such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
