This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners and learned Additional Government Advocate.

The Petitioners have filed this writ petition with the following prayer :

" It is therefore prayed that the writ petition be admitted, relevant records be called for and after hearing the counsel for the Parties allow the Writ Petition directing the Opp.Parties to pay all service benefits as per the 5th Pay Commission Report to the Petitioners who are retied under VRS/VSS during the period from 2005-2007 taking into consideration the recommendation letter dated 06.11.2017 of the Opposite Party No.2 within a stipulated period.

And/or pass any other order(s)/direction(s) as deem just and proper by this Hon'ble Court.

In course of hearing, learned counsel for the Petitioners submits that the Petitioner highlighting their grievance submitted a representation before the Principal Secretary, Cooperation Department, Bhubaneswar, Opposite Party No.1 which may be

// 2 // considered within a stipulated period of time in accordance with law. Learned counsel for the State on the other hand submits that he has no objection if the representation of the Petitioners is considered by the Opposite Party No.1, which is stated to be pending, within a stipulated period of time in accordance with law. However, he submits that since the representation filed by the Petitioners has been signed by only five petitioners, let them file separate representation before the Opposite Party No.1.

In view of the aforesaid limited nature of grievance of the Petitioners, this Court disposes of the writ petition at the stage of admission granting liberty to the Petitioners to file a separate representation before the Opposite Party No.1 ventilating their grievance within a period of two weeks. If such representation is filed within the time stipulated, the same shall be considered and disposed of by the opposite party no.1 in accordance with law within a period of four weeks months thereafter. The Opposite Party No.1 shall do well to dispose of the representation of the Petitioner by passing a speaking and reasoned order. The decision so taken on the representation of the Petitioner, shall be communicated to the Petitioner within a period of two weeks thereafter. 6.

With the aforesaid observation the writ application stands disposed of.

Issue urgent certified copy as per Rules.
