A serious allegation is made against the action of the Order No.

Bhubaneswar Municipal Corporation in the matter of eviction without following due process of law.

Considering the allegation made on behalf of Petitioner to be a serious one and for the settled position of law that there should not be any eviction / demolition without following due process of law, this Court directs, if no such proceeding for clearing the encroachment has been initiated against the Petitioner as yet, there shall be no eviction of the Petitioner from the disputed property in question without following due process of law.

The writ petition stands disposed of with the aforesaid direction.
