Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioners are in custody since 02.12.2021 in connection with Jagatpur P.S. Case No.468 of 2021 corresponding to G.R. Case No.2679 of 2021 pending in the Court of learned J.M.F.C.(R), Cuttack for the alleged commission of offence under Sections 379/413/201/34 of IPC. 4.

The petitioner no.1 is the receiver of the stolen property while the petitioner no.2 is his assistant. It is submitted that charge sheet has already been submitted and the alleged stolen vehicle has since been recovered.

Considering the submissions as above, materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial Court on each date

of posting of the case and in case of even a single default, the Court below shall pass appropriate orders to take them to custody again. Further they shall appear before the IIC of Jagatpur Police Station once in every fortnight for a period of six months and such fact shall be certified by the IIC to the concerned Court once in a month.

BLAPL is accordingly disposed of.
