This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offences punishable under Sections 147/148/294/506/323/149, I.P.C.

Considering the nature of allegation, gravity of the offence and the facts of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is observed that, in the event the Petitioner surrenders before the learned NGN-cum-J.M.F.C., Tangi in G.R. Case No.255 of 2016 corresponding to Nirakarpur P.S. Case No.74 of 2016 within a period of three weeks from today, the Petitioner shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper, besides the conditions that the Petitioner shall cooperate with the trial and shall

// 2 // appear regularly before the learned trial court without fail. Failure to appear before the trial court on any date fixed, shall amount violation of the terms and conditions of bail, and it is open for the learned trial court to proceed against the Petitioner in accordance with law and take any coercive action against the Petitioner. 5.

The ABLAPL is disposed of accordingly.
