1.This matter is taken up through hybrid mode.
2. Heard.
3. In this writ petition, the petitioner seeks a direction to the Opposite Parties in not paying monthly honorarium to the cook-cum-helpers engaged under Mid day meal Scheme in the petitioner's institution, such action of the Opposite Parties are illegal, arbitrary & violative of article 14 & 21 of Constitution of India.
4. Learned counsel for the petitioner submits that since the petitioner's institution is a philanthropy institution
// 2 // providing free education to the tribal economically backward section of the society. The children are covered under Mid day meal Scheme where the Government of School and Mass Education has covered the school under the Mid day meal Scheme. However, the honorarium paid to the cook-cum-helper whose salary is puts as extra burden on the institution which has already taken so many burdens in education to the children.

In such view of the matter the petitioners requested for compensating the honorarium amount which is Rs. 1500/- be compensated by the Government and consider such request sympathetically so that the educational needs of the students along with nutritional back up by the institution can be successfully managed.
5. In view of such facts and submissions made, the authority is directed to consider the representation within the period of one month from the date of submission of the representation.
6. Accordingly, this writ petition is disposed of.
