Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 24.03.2018 in connection with Reamal P.S. Case No. 35 of 2018 corresponding to S.T. Case No.66 of 2018 pending in the court of learned Sessions Judge, Deogarh for the alleged commission of offence under Sections 302/201/34 of IPC. 4.
It is alleged that the petitioner killed his brother and threw his dead body in the village Nala. Subsequently, the body was recovered in a decomposed stale. In so far as the petitioner is concerned, except for the so called extra judicial confession made by him before his daughter and wife and also in the village meeting, there is no other material, prima facie, to show his complicity in the alleged occurrence. 5.
Considering the above facts and the period of detention in custody, I am inclined to allow the prayer for bail. Let the
petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
