Heard learned counsel for the petitioners as well as learned counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

The petitioner is apprehending arrested by Airport P.S. for the allegation of offence under Section 498-A, I.P.C. and Section 31 of PWDV Act, 2005 and other allied offences likely to be filed by the
// 2 // wife.

Learned counsel for the State submits that F.I.R. has not been registered against the petitioner as of now.

Considering the nature of allegation, this Court directs that in the event a case is registered against the petitioner under the aforesaid alleged offences, the Investigating Officer of the concerned Police Station is directed to comply with the mandatory requirement of Section 41-A of the Code of Criminal Procedure. 9.
With the aforesaid observations, the ABLAPL is disposed of. Urgent certified copy of this order be granted on proper application.
