This matter is taken up through Hybrid Arrangement (virtual/physical mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

The petitioner seeking pre-arrest bail in connection with Spl. G.R. Case No.28 of 2022, arising out of Deogarh P.S. Case No.410 of 2022, pending in the court of learned District and Sessions Judge, Deogarh.

It is submitted by leaned counsel for the Petitioner that Petitioner has been named by one co-accused person. He further submits that nothing was recovered from the conscious possession of the Petitioner and a total quantity of 20 kgs. of contraband ganja has been recovered from the co-accused person, who has subsequently been released on bail by this Court.

Considering the nature of allegation, gravity of offences alleged against the Petitioner and the fact of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the leaned court in seisin over the matter, he shall be released on bail on such terms and conditions as would be deemed just and proper with further condition that he shall cooperate the police as and when required for the purpose of investigation.

Accordingly, the ABLAPL is disposed of.
