This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and Mr. C.K. Pradhan, learned Senior panel counsel appearing on behalf of NCB. 3.
The petitioner is an accused in T.R. Case No.22 of 2020, pending on the files of learned Sessions Judge-cum-Special Judge (Special Court), Sambalpur, under Sections 20(b)(ii)(C) of the NDPS Act.

Taking into account the quantity of contraband seized being 577 kgs. and allegations qua the petitioner vis-à-vis such seizure, this Court is not inclined to exercise the discretion in view of the bar contend under Section 37 of the NDPS Act.
