This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.265 of 2022, pending on the files of learned S.D.J.M. Nilagiri, arising out of Nilagiri P.S. Case No.176 of 2022, under Sections 379/34 of IPC and is in custody since 20.05.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Asst. Sessions Judge, Nilgiri, by order dated 06.06.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the petitioner's nature of allegation being under Section 379 of IPC and the period of custody, this Court directs the petitioners to be released on bail. Learned Court in seisin over the

matter to fix the terms including that petitioner shall furnish local sureties.

Accordingly, the BLAPL stands disposed of.
