This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State. Perused the copy of the F.I.R. and the materials on record.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offences punishable under Section 379, I.P.C.

It is submitted by learned counsel for the Petitioner that in the present case F.I.R. was registered against some unknown accused persons. Further it is submitted that the present Petitioner has been falsely implicated in the present case. He further submits that the stolen vehicle has already been recovered by the police in the meantime.

Considering the nature of allegation, gravity of the offence and the facts of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is observed that, in the event the Petitioner surrenders and moves for bail before the learned J.M.F.C., Jatni within three weeks from today in connection with G.R. Case No.315 of 2022 corresponding to Jatni P.S. Case No.181 of 2022, learned J.M.F.C., Jatni shall do well to allow the Petitioner to go on bail on such terms and conditions as deemed just and proper in the facts and circumstances of the case.

The ABLAPL is disposed of accordingly.
