This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.1329 of 2022, on the files of learned J.M.F.C.(R), Cuttack, arising out of Tangi P.S. Case No.118 of 2022, under Sections 379/34 of IPC and is in custody since 27.05.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Cuttack, by order dated 09.06.2022 in the aforementioned case, the present BLAPL has been filed.

It is stated by the learned counsel for the petitioner that one of the co-accused has been released on anticipatory by this Court by order dated 06.07.2022 in ABLAPL No.6564 of 2022.

Taking into account the nature of the allegation, punishment prescribed and release of co-accused on anticipatory bail, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. Additionally it is directed that one of the sureties shall be local sureties.

Accordingly, the BLAPL stands disposed of.
