1. Heard Mr. A. Mohanty, learned counsel on behalf of Mr. B.P. Mohanty, learned counsel for the Appellant-claimant and Mr. N.S. Ghose, learned counsel for the Respondent No.2-Insurance Company.

2. The Appellant has been granted compensation by the learned 4th M.A.C.T., Puri in M.A.C. No.159/486 of 01/99 to the tune of Rs.40,000/- along with interest @7% per annum from the date of filing of the claim application i.e. 20.9.99 on account of his injury sustained in a motor vehicular accident dated 19.9.1999.

3. Having heard both parties and keeping in view the nature of injuries which is fracture of left hand, no illegality is found in the impugned judgment to interfere with the same for enhancement of compensation amount. Further in absence of any documents

towards proof of income, no case is made out in favour of the claimant for enhancement of the compensation amount.

4. Accordingly, the present appeal is dismissed being without merit.
