This matter is taken up through hybrid mode.

Heard the learned counsel for the Petitioner and the learned counsel for the State-Opposite Party. 3.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 19th May, 2015 passed by the learned Special Judge (S.C. & S.T.), Balasore in Special Case No.296 of 2004 of 2015/2014 wherein N.B.W.(A) has been issued against him. 4.

It appears that the case is of the year 2015 and the same is triable by the Special Court.

According to the Petitioner, as he was suffering from cold and fever, he could not present before the trial court on the date fixed. As such, he has come to this Court for quashment of the order of N.B.W.(A) by invoking jurisdiction of Section 482 of Cr.P.C.

However, considering the fact that the Petitioner's default to be willful, as he has already taken several adjournments, this Court does not find any illegality and infirmity in the impugned order.

Accordingly, the CRLMC stands dismissed.
