The matter is taken up through hybrid mode.

Heard Mr. P.K. Nayak, learned counsel for the Petitioner and Mr. S.S. Kanungo, learned Additional Government Advocate. 3.

This application under Section 438 Cr.P.C. has been filed by the petitioner, namely Vikash Agrawal apprehending arrest in connection with Laikera P.S. Case No.271 of 2021, corresponding to C.T. Case No.2562 of 2021 of the Court of learned S.D.J.M., Jharsuguda for offence under Section 379 of the Indian Penal Code. 4.

Mr. Nayak, learned counsel for the Petitioner submits that the Petitioner is not named in the F.I.R. But on the basis of recovery of stolen pipes from his possession, three cases have been registered against him. It is further submitted that except those three cases, the petitioner has no other previous criminal antecedents.

Mr. S.S. Kanungo, learned Additional Government Advocate, on the other hand submits that, this Petitioner is the recipient of the stolen articles. He further confirms that except those three cases in connection with the present theft of pipes, no other criminal antecedent is there against the present Petitioner. 6.

Having heard both parties, it is directed that in the event of arrest of the Petitioner in the aforesaid case, he shall be released on bail on such terms and conditions as the arresting officer may deem just and proper including the condition that, he shall cooperate with the investigation by appearing before the I.O. as and when directed. 7.

The ABLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
