This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner has approached this Court seeking the following relief:- "It is therefore, most humbly prayed that this Hon'ble Court be granted pleased to;

(i) Admit the writ application.

(ii) Call for record.

(iii) Quash the order vide No.4471 dtd.10.11.2021 under Annexure-5 to the writ petition.

(iv) Direct the opposite parties particularly opposite party no.3 to appoint the petitioner for the post of Physical Education Teachers under Contractual basis pursuant to the Advertisement dtd.30.12.2019 under Annexure-1 as he is secure 74.41% marks in the selection list under Annexure-3 as per the resignation of Opp. Parties No. 5 & 6 within a

stipulated time.

(v) And/or pass such other order/orders, direction/directions as this Hon'ble Court may deems fit and proper for the ends of justice." 4.

In course of hearing, it is pointed out that ventilating the self same grievance, the petitioner has submitted a representation on 08.02.2022 to the Director SC and ST Development Department, which is enclosed as Annexure-6. The said representation has not yet been disposed of.

It is submitted that the petitioner despite securing higher marks was not given appointment whereas opposite party Nos. 5, 6 and 7 were appointed, even though they secured less mark than him. However, opposite party Nos. 5 and 6 having resigned subsequently, two posts have fallen vacant. The petitioner claims appointment against one of such posts.

Considering the above fact, the writ petition is disposed of with a direction to the Director SC and ST Development Department (Opposite Party No.2) to consider and dispose of the representation under Annexure 6 within a period of two weeks in accordance with law.

7. The writ petition is disposed of accordingly.
