1. The matter is taken up through Hybrid mode.

2. Heard Mr.Sahoo, learned counsel for the Petitioners and Mr.Kanungo, learned counsel for the State.

3. The Petitioners have prayed to release them under Section 438 Cr.P.C. in connection with Hirakud P.S.Case No.81 of 2022 corresponding to G.R.Case No.1386 of 2022 pending in the court of the learned S.D.J.M., Sambalpur for alleged commission of offences under Sections 147/148/341/294/323/325/354/506/ 149 of the IPC and Section 25 and 27 of the Arms Act.

4. It is submitted by Mr.Sahoo, learned counsel for the Petitioners that due to village dispute, case and counter case was lodged by both parties against each other and the nature of injuries are all simple.

5. Mr.Kanungo, learned counsel for the State opposes the prayer for bail by submitting that Petitioner No.1(Ajaya Kaushal @ Lulu) has criminal antecedents.

5. Upon hearing both parties and considering the nature of injuries as well as background facts, it is directed that in the

event of arrest of the Petitioners in the aforesaid case, they shall be released on bail on such terms and conditions as the arresting officer may deem just and proper including the condition that they shall cooperate with investigation by appearing before the I.O. as and when directed.

6. The ABLAPL is accordingly disposed of.

7. Urgent certified copy of this order be granted on proper application.
