The matter is taken up through hybrid arrangement (physical/virtual) mode.

The Petitioner having been implicated in connection with Baidyanathpur P.S. Case No.64 of 2018 corresponding to G.R. case No.10 of 2019 pending on the file of learned P.O., Designated Court, OPID, Berhampur for alleged commission of offence under Section-420/34 of the IPC read with section-4/5/6 of the Prize Chits and Money Circulation (Schemes) Banning Act, has filed this application under Section-438 of the Cr.P.C. for his release on bail in the event of his arrest in the aforesaid case.

Heard learned counsel for the Petitioner and learned counsel for the State in OPID Cases.

Considering the submissions made and on going through the materials placed including the written notes of submission filed from both sides; this Court is of the considered opinion that in view of the nature and gravity of the accusations and the role

// 2 // said to have been played by the Petitioner therein as also the sufferings of large numbers of innocent depositors, the custodial interrogation is absolutely necessary in the interest of investigation. In that view of the matter, I am not inclined to entertain this application for grant of anticipatory bail to the Petitioner.

The ABLAPL is accordingly dismissed.

Interim order passed on 24.08.2021 does no more survive. It is however observed that when the occasion would so arise for the Court in seisin of the case to consider the matter of grant of regular bail to the Petitioner; the same would stand decided on its own merit without being influenced by this order and disposed of early in accordance with law. Issue urgent certified copy as per rules.
