1. This matter is taken up through hybrid mode. Order No.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 4th May, 2022 in connection with Talsara P.S. Case No.72/2022 corresponding to G.R. Case No.625/2022 pending in the court of learned S.D.J.M., Sundargarh for the alleged commission of the offence under Sections 394/34 of I.P.C. and Sections 25 and 27 of the Arms Act.

It is alleged that the Petitioner being associated with some other persons committed theft of huge amount of money from the informant and another person and also assaulted them by means of a Bhujali. The Petitioner appears to have been implicated entirely on the basis of the statement of the coaccused, Girish Bagha. Further a sum of Rs.11,500/- was also recovered from the Petitioner.
5. Considering the fact that the implication of the Petitioner appears to have been entirely on the basis of the co-accused, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear personally before the trial court on each date of posting of the case without fail.
6. The BLAPL is disposed of.
7. Urgent certified copy of this order be granted on proper application.
