The matter is taken up through hybrid mode.

Heard Mr. S.K. Samantaray, learned counsel for the Petitioner and Mr. A.K. Nanda, learned Additional Government Advocate. 3.

This application under Section 438 Cr.P.C. has been filed by the petitioner, namely Lucky Mallick apprehending arrest in connection with Chauliaganj P.S. Case No.87 of 2021, corresponding to G.R. Case No.247 of 2021 of the Court of learned J.M.F.C. (City), Cuttack for offence under Sections 294/506/34 of the Indian Penal Code, read with Section 25/27 of Arms Act.

Considering the allegations and the nature of offences, I am not inclined to release the Petitioner on anticipatory bail. Accordingly, his prayer for anticipatory bail is rejected.

However, as prayed on behalf of the Petitioner, he is at liberty to surrender before the concerned court below and move for bail. In

such event, his prayer for bail shall be considered in accordance with law.
