Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

The Petitioner is in custody since 16th April, 2022 in connection with Cyber Crime & E.O. Balasore P.S. Case No.5 of 2022 corresponding to C.T. Case No.342 of 2022 pending in the court of learned S.D.J.M., Balasore for the alleged commission of the offence under Sections 419/420/465/467/468/471/120-B of I.P.C. read with Sections 66(C)/66(D)/84(b) of I.T. Act. 4.
It is alleged that the Petitioner was in possession of SIM card and was using the same for obtaining OTP for activation of new accounts fraudulently. On instructions, learned State counsel submits that the SIM card recovered from the possession of the Petitioner was not used for committing any offence. 5.
Considering the submissions as above, the materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear personally before the court below on each date of posting of
the case without fail.

The BLAPL is disposed of.
