1. The Petitioner has prayed to release him under Section 438, Cr.P.C. in connection with Bisam Katak P.S. Case No.46 of 2021 corresponding to T.R. Case No.26 of 2021 pending in the court of learned Sessions Judge-cum-Special Judge, Rayagada for alleged commission of offences under Sections 363/366/376(2)(n)/ 376(3)/109, I.P.C. and Sections 6/17 of the POCSO Act.

2. Heard Mr. D.J. Sahoo, learned counsel for the Petitioner as well as Mr. A.K. Nanda, learned Additional Government Advocate for the State-Opposite Party.

3. Considering the nature of offences which includes the Section 376(3), I.P.C., the prayer for anticipatory bail is rejected as not entertainable as per the provisions contained in Section 438(4) Cr.P.C.
