The matter is taken up through hybrid mode.

Heard Mr. J.K. Panda, learned counsel for the Petitioner and Mrs. S. Pattnaik, learned Additional Government Advocate. 3.

This application under Section 438 Cr.P.C. has been filed by the petitioner, namely P. Susanta Dora apprehending arrest in connection with Adava P.S. Case No.79 of 2020, corresponding to G.R. Case No.48 of 2020 of the Court of learned Special Judge-cumSessions Judge, Gajapati, Paralakhemundi for offence under Sections 20(b)(ii)(C)/25/29 of the NDPS Act for alleged possession of contraband weighing 1634 Kg. 300 grams.

Upon hearing both parties and keeping in view the nature of offences alleged, the prayer for anticipatory bail is rejected.

However, as prayed on behalf of the Petitioner, he is at liberty to surrender before the court below and seek for his release on bail. 6.

In the event the Petitioner surrenders within a period of four weeks, before the concerned court below and moves for bail, the same shall be considered in accordance with law including the ground of parity, if any, as submitted by the Petitioner. It is made clear that this court has not expressed any opinion on merit of the case. 7.

The ABLAPL is accordingly disposed of.
