The matter is taken up through hybrid mode.

Heard Mr. S.K. Samantaraya, learned counsel for the Petitioner and Mr. S.S. Kanungo, learned Additional Government Advocate. 3.
This application under Section 438 Cr.P.C. has been filed by the petitioner, namely Subhranshu Samantaray apprehending arrest in connection with Khurda P.S. Case No.92 of 2022, corresponding to T.R. Case No.18 of 2022 of the Court of learned Additional Sessions Judge-cum-Judge (Special Court), Khurda for offence under Sections 341/323/294/506/34 of the Indian Penal Code read with Section 3(1)(r)(s)/3(2)(va) of SC & ST (PoA) Act.

Mr. Samantaray, learned counsel for the Petitioner seeks withdrawal of the bail application with liberty to surrender before the concerned court below.

Accordingly, the ABLAPL is disposed of as withdrawn. 6.
However, as prayed on behalf of the Petitioner, in the event he surrenders within a period of four weeks from today before the concerned court below and seek for bail, his prayer for bail shall be considered in accordance with law and in terms of the decision reported in 2017 (II) OLR-44 (Pramod Kumar Ray and other vs. State of Odish) including the procedure mentioned in Sec.15-A of the SC & ST (POA) Act. Learned court below shall also consider to release the Petitioner on interim bail.

The ABLAPL is accordingly disposed of.
