Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 31.01.2022 in connection with Jharsuguda P.S. Case No.50 of 2022 corresponding to C.T. Case No.268 of 2022 pending in the Court of learned S.D.J.M., Jharsuguda for the alleged commission of offence under Sections 363/366 of IPC. 4.

It is alleged that the petitioner kidnapped the victim, who is a minor girl. The victim was rescued by police subsequently and her statement under Section 164 Cr.P.C. was recorded, in which she admitted that she was in love with the petitioner since 2020. As her family members did not approve of such relationship she asked the petitioner to take her away from her house. The above fact has been mentioned in the charge sheet indicating that the case is one of consensual elopement. 5.

Considering the submissions, materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such

terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
