1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 8th May, 2022 in connection with Kakatpur P.S.

Case No.79/2022 corresponding to G.R. Case No.436/2022 pending in the court of learned Addl. Sessions Judge, Nimapara for the alleged commission of the offence under Sections 399 and 402 of I.P.C.

4. It is alleged that the Petitioner along with four other persons were making preparation to commit dacoity at a Petrol Pump and were trying to detain the vehicles passing by when they were apprehended. Several incriminating articles including the weapons were recovered from their possession.

5. Considering the submissions made, the materials on record and the fact that the intended offence has actually not been committed, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear personally before the court below on each date of posting of the case without fail. Further, he shall appear before the concerned P.S. once on every Monday at 10.00 A.M. for a period of six months and such fact shall be certified by the I.I.C. to the concerned Court once in a month.

6. The BLAPL is disposed of.

7. Urgent certified copy of this order be granted on proper application.
