This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State.

The writ petition has been filed by the Petitioner with the following prayer:

"In view of the aforesaid fact s and circumstances as narrated above, it is ardently prayed that this Hon'ble Court may kindly be directed the Opp. Party No.1 to release the unutilized leave salary of petitioner with interest thereon at the rate of 7% per annum from the date of entitlement to till the date of final payment within a time stipulation as fixed by this Hon'ble Court. And/or issue any other appropriate writ/writs, order/orders, direction/directions as deem fit and proper in the fitness of the case.

And for this act of this kindness as in duty bound the petitioner shall ever pray."

Learned counsel for the Petitioner submits that ventilating his grievance, Petitioner has filed a representation before the Secretary to Govt. Home Department, Odisha, Bhubaneswar, Opposite Party No.1, which according to the Petitioner is pending before the Authority for consideration.

Considering the limited nature of grievance and considering the facts and circumstances of the case, this Court directs the Secretary to Govt. Home Department, Odisha, Bhubaneswar, Opposite Party No.1 to consider the representation of the Petitioner dated 15.12.2021 (Annexure-4) within a period of two months from the date of receipt of certified copy of this order, strictly in accordance with law, by passing a speaking and reasoned order. Decision so taken be communicated to the Petitioner within a period of two weeks thereafter.

With the above direction, the writ petition stands disposed of.

Issue urgent certified copy of this order on proper application.
